MAYBE HE'D'VE BEEN MORE COOPERATIVE IF YA HADN'T'VE EVICTED HIM!
Too late to cry over spilled(or is it 'spilt') milk....but....seems the court wants to borrow some big bucks and the guy that's playing musical offices has the final 'initial' say over whether it can happen or not says it ain't gonna happen!
PDN's Gene Park reports that the AG says it's illegal for the Judicial Council to borrow money by opening a line of credit...that
the JC seeks a financial institution to provide an LC that would be used to make timely payments to lawyers representing indigent defendants to those unable to pay for legal counsel....but as Park reports, the AG wrote to Perry Taitano the Judiciary of Guam administrative director, stating the court's plan to borrow $750,000 violates a federally set borrowing ceiling, contending that govGuam can't exceed the island's limit defined by the Organic Act.
Park's report also states tat there's a dispute about whether the debt ceiling should be based on the full value of the island's real
property or on it's taxable value which is 35 percent of its full value, the OA not being specific on the issue, setting the limit at 10% of the 'aggregate tax valuation."(read it on PDN's webpage)
Perhaps the point I'm trying to get accross is that the AG might have been a little bit more cooperative if he hadn't have been treated so shabbily.......those guys who handle indigent cases? You can wait until the cows come home(I mean until the tax refunds for the current year)before you see your checks!
